Thank you for choosing Vive Content LLC for your content creation needs. We are committed to delivering high-quality digital content that enhances your brand's presence. These Terms of Service ("TOS") are designed to clarify our mutual rights and obligations, ensuring a transparent, fair, and beneficial experience for both parties.
Copyright and Usage Rights
Copyright of all digital content produced by Vive Content LLC remains with us until full payment is received, after which clients are granted a license to use the content for specific purposes agreed upon at the time of booking. This includes commercial use, subject to the terms of the individual contract. Unauthorized use, reproduction, or distribution of the content is strictly prohibited.
Payment Terms
For subscription services, clients may choose from various tiered options, each providing a set amount of content per month. Subscription fees are billed monthly and are non-refundable. Clients can modify, pause, or cancel their subscription at any time without any notice requirement.
For individual projects, a non-refundable deposit of 50% is required to secure your booking. This deposit is reschedulable with more than 48 hours’ notice and can be applied to a rescheduled project. The remaining balance is due prior to the delivery of the final content. We accept all major credit and debit cards, bank transfers, and selected digital payment platforms.
Liability
Vive Content LLC is not liable for any indirect damages that may arise during or after the delivery of our services, except in cases of gross negligence or willful misconduct. We take meticulous care in all aspects of our content creation and handling.
Client Responsibilities
Clients are expected to provide all necessary information, materials, and approvals promptly as requested by Vive Content LLC to ensure a smooth workflow. Cooperation is essential to achieving the best results.
Delivery of Work
For subscription services, content is delivered on an ongoing basis as per the agreed schedule. For individual projects, final content is typically delivered within 2-3 business days after completion, unless otherwise specified. The files are provided in a high-resolution format suitable for the agreed-upon uses. Rush delivery options are available upon request and may incur additional fees.
Revisions and Approval Process
Subscribers enjoy a predetermined number of revisions per month as part of their package, fostering ongoing refinement and satisfaction. For individual projects, the number of revisions and the process for requesting and implementing these will be outlined in the project-specific contract. Additional revisions may be subject to extra charges.
Dispute Resolution
In the unlikely event of a dispute, both Vive Content LLC and the client agree to seek resolution through direct communication. If a resolution cannot be reached, we agree to enter mediation before pursuing any other legal remedies.
Privacy Policy
Vive Content LLC respects your privacy and is committed to protecting your personal data. Information collected from clients is used solely for the purpose of providing and improving our services. We do not share personal information with third parties without explicit consent, except as required by law.
Prohibited Industries
Vive Content LLC does not work with clients involved in the following industries:
Tobacco
Firearms and Ammunition
Oil and Gas
Pharmaceutical Companies involved in unethical practices
Gambling
Political Campaigns or Parties
Prisons and Correctional Facilities
Animal Testing and Factory Farming
Any business engaged in practices that are illegal, unethical, or promote hate speech
Amendments to the TOS
These TOS may be updated or modified from time to time to reflect changes in our practices or services. Clients will be notified of any significant changes, and continued use of Vive Content LLC’s services will constitute acceptance of the new terms.
